Welcome to FitTriangle (hereinafter referred to as “the App,” “we,” or “the Service”). Please read these Terms of Use carefully. By using the App, you agree to comply with and be bound by all provisions of these Terms of Use. If you do not agree to these terms, please do not use the App.

1. Service Description

FitTriangle is a health and fitness management application designed to help users record, track, and manage personal health data. The App provides the following features:

• Workout Plan Management: Create and manage personalized workout plans
• Exercise Records: Record and track daily exercise activities
• Sleep Management: Record and analyze sleep data
• Nutrition Tracking: Track daily dietary intake
• Health Data Visualization: Display health data through charts such as the “Fit Triangle”
• Data Sync: Sync data across multiple devices via iCloud
• HealthKit Integration: Sync health data with Apple Health app
• Achievement Sharing: Generate and share health achievement images

2. User Accounts and Responsibilities

2.1 Account Requirements

Using the App requires you to have a valid Apple ID. You are responsible for maintaining the security and confidentiality of your account.

2.2 User Responsibilities

You agree to:

• Provide accurate and truthful personal health information
• Not use the App for any illegal activities
• Not attempt to hack, reverse engineer, or interfere with the normal operation of the App
• Not upload or share any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable

2.3 Age Restrictions

You must be at least 13 years old to use the App. If you are under 18 years old, you must use the App with the consent of a guardian.

3. Subscription Service Terms

3.1 Free Version Features

Free version users can access the following features:

• Create up to 3 workout plans
• Add up to 5 manual exercise records per week
• View current week’s data
• Basic iCloud data synchronization

3.2 Premium Subscription

Premium subscription includes the following additional features:

• Unlimited workout plan creation
• Unlimited manual exercise records
• Automatic exercise data synchronization
• View all historical weekly data
• Progress bar display
• Achievement image sharing functionality

3.3 Subscription Pricing and Cycles

• Subscription prices will be clearly displayed at the time of purchase
• Subscriptions are automatically renewing
• Subscription cycles and prices are as displayed within the App

3.4 Auto-Renewal

• Subscriptions will automatically renew unless you turn off auto-renewal at least 24 hours before the end of the current subscription period
• Your account will be charged for renewal within 24 hours prior to the end of the current subscription period
• Renewal fees will be the same as the initial subscription fee, unless we notify you in advance of a price change

3.5 Managing and Canceling Subscriptions

You can manage or cancel your subscription through the following steps:

1. Open the “Settings” app on your iPhone
2. Tap your Apple ID (your name at the top)
3. Tap “Subscriptions”
4. Select the FitTriangle subscription
5. Select “Cancel Subscription”

Cancellation will take effect at the end of the current subscription period, and you can continue using Premium features until the subscription period ends.

3.6 Refund Policy

• All subscriptions purchased through the App Store are subject to Apple’s refund policy
• Refund requests must be submitted through Apple
• We do not directly process refunds; all refund decisions are made by Apple

3.7 Free Trial

If a free trial is offered:

• The free trial period will be clearly displayed on the subscription interface
• After the free trial period ends, if the subscription is not canceled, it will automatically convert to a paid subscription
• You can cancel at any time during the trial period without being charged

3.8 Restore Purchases

If you use the App on multiple devices, you can restore your subscription status through the “Restore Purchases” feature without paying again.

4. Data and Privacy

4.1 Data Collection and Storage

The App collects and processes health data that you provide when using the App, including but not limited to:

• Exercise records
• Sleep data
• Nutrition records
• Workout plan information

Important Note: All data is stored only on your device locally and in your own iCloud account. We cannot access, view, or read any of your personal health data.

4.2 Scope of Data Use

Your data is used only for:

• Displaying your health data and analysis results on your device
• Syncing data between your devices via iCloud (only your own devices)

We do not collect, transmit, or analyze your data for:

• Improving the App’s functionality
• Data analysis or research
• Any commercial purposes
• Sharing with third parties

4.3 Data Privacy Guarantees

• All your health data belongs entirely to you
• We, as developers, cannot see, access, or obtain any of your data
• All data is stored on your device locally and in your personally controlled iCloud account
• We will not collect, transmit, or store any of your data on our servers

4.4 HealthKit Data

• The App will request access to your Apple Health data
• Data read from HealthKit is used only for display and analysis within the App
• Data is processed only locally on your device and will not be uploaded to any servers
• We cannot access your HealthKit data
• You can revoke the App’s access to HealthKit in iOS Settings at any time

4.5 iCloud Sync

• The App uses iCloud to sync your data for convenient use across multiple devices
• Important Note: iCloud data is stored entirely in your own Apple account, accessible only to you
• We cannot access any data in your iCloud
• iCloud data storage and transmission are subject to Apple’s privacy policy
• You can manage iCloud sync options in your device settings
• If you disable iCloud sync, data will be stored only locally on your device

4.6 Data Security

• Your data security is protected by Apple’s iCloud and local device security mechanisms
• We recommend that you:
  • Use a strong password to protect your Apple ID
  • Enable device passcode or Face ID/Touch ID
  • Regularly back up your data

4.7 Data Retention and Deletion

• Your data will be retained on your device and in your iCloud account until you actively delete it
• If you delete the App, local data will be deleted
• Data in iCloud will be retained according to Apple’s iCloud policy
• You can delete all your information at any time by deleting the App or clearing data

4.8 Third-Party Services

• The App uses Apple’s HealthKit and iCloud services
• These services are subject to Apple’s privacy policy
• We are not responsible for the privacy policies of these third-party services, but we can confirm that we do not obtain your data through these services

5. Health Disclaimer

5.1 Not Medical Advice

The information and features provided by the App are for informational purposes only and do not constitute medical advice, diagnosis, or treatment. The App cannot replace professional medical consultation, diagnosis, or treatment.

5.2 Usage Risks

• Before starting any new workout plan, please consult a doctor or qualified health professional
• If you feel unwell while exercising with the App, please stop immediately and seek medical help
• The App should not be used to diagnose, treat, cure, or prevent any disease

5.3 Data Accuracy

While we strive to ensure the App provides accurate data, we do not guarantee the complete accuracy of data obtained through HealthKit or other channels.

6. Intellectual Property

6.1 Ownership

The App and all its content, features, and design, including but not limited to text, graphics, images, code, and software, are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

6.2 Usage License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial use.

6.3 Restrictions

You may not:

• Copy, modify, distribute, sell, or rent any part of the App
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or other proprietary notices from the App
• Use the App for any commercial purpose

6.4 User-Generated Content

Training plans, records, and other content you create in the App belong to you. By using the sharing feature, you grant us the right to use such content to the extent necessary to provide the service.

7. Third-Party Services

7.1 Apple Services

The App integrates the following Apple services:

• Apple Health (HealthKit)
• iCloud
• StoreKit (In-App Purchases)

These services are subject to Apple’s respective terms of use and privacy policy.

7.2 Disclaimer

We are not responsible for the availability, accuracy, or performance of third-party services.

8. Service Changes and Termination

8.1 Service Changes

We reserve the right to modify, suspend, or terminate all or part of the App’s functionality at any time without prior notice.

8.2 Termination of Use

We may terminate or suspend your access to the App for the following reasons:

• Violation of these Terms of Use
• Engagement in fraudulent or illegal activities
• Other reasons we deem reasonable

8.3 Consequences of Termination

After account termination:

• You will lose access to the App
• Your data may be deleted
• Active subscriptions will be handled according to Apple’s policy

9. Warranty Disclaimer

The App is provided “as is” and “as available” without any express or implied warranties, including but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties of non-infringement
• Warranties that the service will be uninterrupted or error-free
• Warranties regarding the accuracy or reliability of results

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or use
• Business interruption
• Any damages resulting from inability to use the App

Even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless us, our affiliates, employees, agents, and partners from any claims, losses, liabilities, expenses arising from:

• Your use of the App
• Your violation of these Terms of Use
• Your infringement of others’ rights

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the People’s Republic of China.

12.2 Dispute Resolution

Any disputes arising from these Terms of Use shall first be resolved through friendly negotiation. If negotiation fails, disputes may be resolved through litigation.

13. Changes to Terms

We may update these Terms of Use from time to time. Updated terms will be notified to you within the App or through other appropriate means. Continued use of the App after changes indicates your acceptance of the updated terms.

Material changes will be notified 30 days in advance.

14. Severability

If any provision of these Terms of Use is found to be invalid or unenforceable, that provision shall be limited or deleted to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms of Use constitute the entire agreement between you and us regarding the use of the App and supersede all prior oral or written agreements.

17. Apple-Specific Terms

17.1 Recognition of App Store Rules

You acknowledge and agree that:

• These Terms of Use are an agreement between you and us, not with Apple
• We (not Apple) are solely responsible for the App and its content
• To the extent permitted by applicable law, Apple has no obligation to provide maintenance and support services for the App

17.2 Third-Party Beneficiaries

Apple and its subsidiaries are third-party beneficiaries of these Terms of Use. Upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms of Use against you as a third-party beneficiary.
